These Terms of Service (“Terms”) govern your access to and use of the XP Life website, web application, and related services (collectively, the “Service”).

By creating an account, accessing, or using the Service, you agree to be bound by these Terms.

1. Service Provider

If you use the Service on behalf of a company or other legal entity, you represent that you are authorized to bind that entity to these Terms.

2. About XP Life

XP Life is a web application designed to help users track habits, tasks, routines, and personal progress using gamified mechanics, including points, streaks, rewards, insights, and optional AI-powered features.

We may update, modify, suspend, or discontinue parts of the Service from time to time.

3. Eligibility and Accounts

You must be at least 18 years old, or the age of legal majority in your jurisdiction, to use the Service independently.

To use certain features, you must create an account and provide accurate, complete, and up-to-date information.

You are responsible for:

  • maintaining the confidentiality of your login credentials,
  • all activities that occur under your account,
  • ensuring that your use of the Service complies with applicable law.

You must notify us promptly if you believe your account has been accessed without authorization.

We may suspend or restrict access to your account if we reasonably believe that you breached these Terms, your account is being used fraudulently or unlawfully, or suspension is necessary to protect the Service, other users, or us.

4. Acceptable Use

You agree not to:

  • use the Service for any unlawful, fraudulent, or abusive purpose,
  • interfere with or disrupt the integrity or performance of the Service,
  • attempt to gain unauthorized access to the Service, accounts, systems, or networks,
  • copy, scrape, reverse engineer, decompile, or exploit the Service except where such restriction is prohibited by law,
  • upload or submit content that is unlawful, defamatory, infringing, harmful, or malicious,
  • use automated means to access the Service in a way that imposes unreasonable load,
  • misuse AI features or generate content that violates law or third-party rights.

We may investigate violations and take appropriate action, including suspension or termination.

5. User Content

You may submit or store content in the Service, including habit names, task descriptions, notes, rewards, preferences, and similar data (“User Content”).

You retain ownership of your User Content.

You grant us a non-exclusive, worldwide, royalty-free license to host, store, process, reproduce, and display User Content solely to the extent necessary to operate, maintain, improve, and provide the Service to you.

You are solely responsible for your User Content and confirm that you have the necessary rights to use and submit it, it does not violate any law or third-party right, and it does not contain malicious code or harmful material.

6. AI-Powered Features

Certain features may use third-party AI models and services.

AI-generated outputs are provided for informational and assistive purposes only. They may be incomplete, inaccurate, misleading, or unsuitable for your specific circumstances.

You remain solely responsible for reviewing and deciding whether to act on any AI-generated output.

The Service is not intended to provide medical, psychological, legal, financial, or other regulated professional advice. AI outputs must not be relied on as a substitute for professional judgment or advice.

To provide AI features, we may transmit relevant input data to third-party AI providers as described in our Privacy Policy.

We do not guarantee the accuracy or quality of AI-generated output, uninterrupted availability of AI features, or that specific models or providers will remain available. We may change, limit, or discontinue AI features at any time.

7. Plans, Pricing, and Billing

XP Life offers free and paid plans. Details of current plans, features, pricing, billing intervals, and limits are presented on the Service at the time of purchase.

Unless stated otherwise:

  • paid subscriptions renew automatically for successive billing periods,
  • fees are charged in advance at the start of each billing period,
  • you authorize the payment provider to charge the applicable subscription fees and taxes using your selected payment method.

If payment cannot be completed, we may suspend or cancel access to paid features. We may change prices for future billing periods with advance notice where required by law.

8. Cancellation and Termination of Paid Plans

You may cancel your paid subscription at any time through your account settings or the billing portal.

Cancellation takes effect at the end of the current paid billing period, and you will retain access to paid features until that date.

Except where required by mandatory law, fees already paid are non-refundable. Nothing in these Terms limits any mandatory consumer rights you may have under applicable law.

9. Consumer Rights

If you are a consumer residing in the European Union or another jurisdiction with mandatory consumer protection laws, those laws may give you rights that cannot be excluded or limited by contract. Nothing in these Terms is intended to exclude or limit such mandatory rights.

10. Intellectual Property

The Service, including its software, design, branding, text, graphics, interfaces, and underlying technology, is owned by or licensed to us and is protected by intellectual property laws.

Except for the limited right to use the Service under these Terms, no rights are granted to you. You may not use our name, logo, branding, or other proprietary materials without prior written permission.

11. Availability, Changes, and Maintenance

We aim to keep the Service available and functioning properly, but we do not guarantee that the Service will always be uninterrupted, secure, error-free, or available at all times.

We may perform maintenance, introduce updates, add or remove features, and impose reasonable technical limits. Where practical, we will try to provide advance notice of major planned downtime.

12. Data Deletion and Account Closure

You may request deletion of your account at any time through account settings or by contacting us.

Upon account deletion, we will delete or anonymize your personal data and User Content as required by applicable law and our Privacy Policy, subject to legal, tax, fraud prevention, security, backup, and dispute-resolution retention needs.

We may terminate or suspend your access immediately if you materially breach these Terms, we are required to do so by law, or your use presents risk or harm to us, the Service, or other users.

13. Third-Party Services

The Service may rely on or integrate with third-party services, such as authentication providers, hosting providers, analytics providers, payment processors, and AI providers. We are not responsible for third-party services, and your use of them may be subject to separate terms and privacy policies.

14. Disclaimers

To the maximum extent permitted by law, the Service is provided on an “as is” and “as available” basis. We disclaim all warranties, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability.

15. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages.

Our total aggregate liability shall not exceed the total amount paid by you to us during the 12 months preceding the event, or EUR 50 if you have not paid anything. This limitation does not apply to liability that cannot be excluded under applicable law.

16. Indemnity

To the extent permitted by law, you agree to indemnify and hold us harmless from claims, liabilities, damages, losses, and expenses arising out of your misuse of the Service, your User Content, your violation of these Terms, or your violation of applicable law or third-party rights.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice through the Service, by email, or by other reasonable means before the updated Terms take effect.

Your continued use of the Service after the effective date means you accept the updated Terms. If you do not agree, you must stop using the Service and cancel your subscription if applicable.

18. Governing Law and Disputes

These Terms are governed by the laws of Poland, excluding conflict of laws rules.

If you are a consumer, this choice of law does not deprive you of mandatory protections granted by the law of the country where you habitually reside. Any disputes that cannot be resolved amicably shall be submitted to the competent courts in Poland, unless mandatory consumer law provides otherwise.
